By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Blooprint provides advertising analytics and management tools for e-commerce platforms including Amazon, Flipkart, and other marketplaces. Our Service includes:

• Campaign creation and management tools
• Bid optimization and automation
• Performance analytics and reporting
• Keyword and targeting management
• Integration with third-party advertising platforms

3. Account Registration and Security

3.1 Account Creation

• You must provide accurate, current, and complete information during registration
• You must be at least 18 years old to use our Service
• Each user must have their own account; account sharing is prohibited
• We reserve the right to refuse or terminate accounts at our discretion

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must immediately notify us of any unauthorized access or security breach
• You are responsible for all activities that occur under your account
• We are not liable for any loss resulting from unauthorized use of your account

4. Third-Party Platform Credentials

• You authorize us to access your third-party advertising accounts to provide the Service
• You are responsible for ensuring your use complies with third-party platform terms of service
• We are not responsible for actions taken by third-party platforms regarding your accounts
• You may revoke access at any time by disconnecting your accounts

5. Data Accuracy Disclaimer

• Data shown in our Service is dependent on third-party API availability and accuracy
• There may be delays, discrepancies, or errors in the data we display
• You should independently verify all data before making business decisions
• We are not liable for any decisions made based on data displayed in our Service
• Historical data accuracy is not guaranteed and may change due to third-party data corrections
• Real-time data may be delayed by minutes, hours, or days depending on source platforms

6. Limitation of Liability

• No Warranty: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• No Guarantee of Results: We do not guarantee any specific results, revenue improvements, or advertising performance from using our Service
• Limitation of Damages: IN NO EVENT SHALL BLOOPRINT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
• Maximum Liability: OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
• Third-Party Actions: We are not liable for any actions, policies, or terms of third-party platforms (Amazon, Flipkart, etc.)

7. Data Breach and Security Incidents

• While we implement industry-standard security measures, no system is completely secure
• In the event of a data breach, we will notify affected users as required by applicable law
• We are not liable for unauthorized access resulting from your failure to maintain account security
• We are not liable for data breaches at third-party platforms
• Our liability for data breaches is limited to the extent permitted by applicable law

8. Indemnification

You agree to indemnify, defend, and hold harmless Blooprint, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of third-party platform terms of service
• Any content or data you submit through the Service
• Any business decisions made based on data from our Service

9. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools to scrape, copy, or extract data from our Service
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others
• Use the Service to harm competitors or engage in unfair business practices
• Submit false, misleading, or fraudulent information

10. Intellectual Property

11. Subscription and Payment

11.1 Fees

• Fees are based on your selected subscription plan
• All fees are non-refundable unless otherwise specified
• We reserve the right to change pricing with 30 days' notice

11.2 Cancellation

• You may cancel your subscription at any time
• Access continues until the end of your billing period
• No refunds for partial billing periods
• We may suspend or terminate accounts for non-payment

12. Service Modifications and Availability

• We may modify, suspend, or discontinue any part of the Service at any time
• We do not guarantee uninterrupted or error-free service
• Scheduled maintenance will be communicated in advance when possible
• We are not liable for any service interruptions or data loss

13. Termination

• Either party may terminate this agreement at any time
• We may terminate or suspend your account immediately for Terms violations
• Upon termination, your right to use the Service ceases immediately
• We may retain your data as required by law or for legitimate business purposes
• Sections on Limitation of Liability, Indemnification, and Governing Law survive termination

14. Governing Law and Dispute Resolution

• Governing Law: These Terms are governed by the laws of India
• Jurisdiction: Courts in Bangalore, Karnataka, India shall have exclusive jurisdiction
• Arbitration: Disputes may be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996
• Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions

15. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, government actions, internet outages, or third-party service failures.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blooprint regarding the Service and supersede all prior agreements.

18. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
